In a recent turn of events, the 8th Court of Appeals in El Paso has ruled in favor of James “Jim” White III, impacting the ongoing legal dispute over the management of the historic Brite Ranch. This decision voids the previous trial that removed White as the ranch’s trustee, according to detailed reporting by Rob D’Amico for the Big Bend Sentinel.
The appeals court found that the 394th District Court did not properly structure the charges during the summer 2023 trial, specifically questioning whether White had acted with intent for personal gain while managing the ranch. This error was deemed significant enough to potentially influence the jury’s decision, which had originally agreed with Jim’s siblings, Mac White and Beau White. The siblings had accused Jim of breaching his fiduciary duty by not acting as a “prudent investor” and failing to make distributions from the trust.
Following the appeals court ruling, Ted Lyon, Jim White’s attorney, expressed that this decision reinstates his client as the trustee of the Brite Ranch. Additionally, the ruling could reverse the $230,000 in legal fees awarded to Susan Combs, the interim trustee, in a December 9 hearing. The case’s future remains uncertain with numerous post-trial pleadings still unresolved, including petitions from Jim’s children, notably Cuatro White.
Lyon indicated that the legal team plans to review the status of all matters post-holiday and will seek potential settlement discussions with Mac and Beau’s legal representatives. Despite previous attempts, including four mediation sessions over six years, no settlement has been reached.
Debra McClure, the principal counsel for Mac and Beau in the appeal, has not yet responded to requests for comment.
