In a memo circulated to the Jeff Davis County Commissioners Court, County Attorney Glen Eisen proposed an ordinance that would prohibit recording in public areas of the courthouse. The justification centered not on law or policy—but on a personal attack against Big Bend Times Publisher David Flash.

“The individual in question… confronts individuals at the courthouse with recording devices, sometimes aggressively… Videos are then edited and posted online to paint a false narrative.”

That statement is false.

David Flash does not ambush people. He identifies himself, films in public areas, and publishes unedited videos that have consistently proven truthful—even when they make public officials uncomfortable. This memo wasn’t about protecting courthouse operations. It was retaliation—plain and simple—for journalism Jeff Davis County officials didn’t like.

And it wildly misrepresents what Big Bend Times actually does.

Why Eisen’s Memo Was False and Unprofessional

Glen Eisen’s memo:

  • Contained provably false statements about David Flash’s conduct.
  • Alleged “edited” and “ambush” videos—when the full videos are published uncut.
  • Targeted a specific journalist, violating viewpoint neutrality.
  • Misrepresented constitutional rights to record in public areas.
  • Was written after Big Bend Times reported on Eisen’s own breach of confidentiality.

This was not law. It was retaliation.
