Hundreds of Criminal Cases Left Unprosecuted as Former Presidio County Attorney Exits Office

Former Presidio County Attorney Rod Ponton declined to prosecute 259 misdemeanor cases, including 60 DWIs, as he prepared to leave office following his election loss to Blair Park, according to a Big Bend Sentinel analysis of court records.

In addition to the declined cases, Ponton dismissed 50 others, citing legal time limits and issues with evidence. Park, who took office on Jan. 1, said the backlog put strain on the county clerk’s office.

Most of the dismissed cases were traffic violations, but some involved more serious charges, including assault with bodily injury, deadly conduct, and indecent exposure.
