Texas State Police Officer Lets Driver With No ID, No License Continue Through Town—Without Calling Border Patrol

A traffic stop near Davis Mountains State Park on Sept. 15, 2023, has drawn scrutiny after a Texas State Park Police officer allowed a driver who showed indications they may be an undocumented immigrant to continue operating a vehicle through town rather than calling U.S. Border Patrol.

The officer, identified as Jacob Barton, stopped the vehicle near tall grass, posing a potential fire hazard. According to observations at the scene, the driver spoke only Spanish, lacked a driver’s license, and had no proper identification. Barton, who reportedly does not speak Spanish, opted not to involve federal immigration authorities. Instead, he directed the driver to continue approximately 3.5 miles into Northeast Fort Davis, where they had contacts who could interpret.

The incident raises concerns over enforcement inconsistencies at a time when Texas state officials frequently highlight their efforts to address illegal immigration more aggressively than the federal government. Border Patrol, which regularly patrols the same area, may have handled the situation differently.

Compounding the concerns, Barton reportedly failed to stop at a stop sign at the intersection of TX 17 and 118, proceeding without activating emergency lights.

A formal complaint has been filed regarding Barton’s handling of the stop, particularly his decision to allow an unlicensed driver who showed indications they may be an undocumented immigrant to continue operating a potentially non-compliant vehicle through town.

As scrutiny on immigration enforcement grows across Texas, this case stands out as a moment where state-level enforcement may not have been as stringent as expected.
