Investigation Exposes Inappropriate Behavior and Unauthorized Operation Involving Border Patrol and TXDPS

A recent investigation conducted by the Office of Professional Responsibility (OPR) has uncovered concerning incidents of inappropriate conduct and unauthorized operations involving U.S. Border Patrol personnel and the Texas Department of Public Safety (TXDPS). The investigation’s findings highlight an instance where HPU personnel engaged in an operation at the request of TXDPS, which directly contradicted U.S. Border Patrol’s operational objectives. Additionally, a Border Patrol Agent’s use of abusive language towards migrants during the incident has raised serious concerns.

The investigation revealed that HPU personnel were directed to carry out an operation by TXDPS, despite the operation conflicting with the established operational goals of the U.S. Border Patrol. This unauthorized operation resulted in the unnecessary use of force against migrants who were attempting to reenter the United States with food. Despite the supervisor’s authorization, the operation lacked clear guidance from higher-ups in the USBP chain of command.

Furthermore, one Border Patrol Agent’s behavior during the incident has raised significant alarm. The agent engaged in unprofessional conduct by yelling derogatory comments related to a migrant’s national origin and sex. The agent’s comments were offensive and inappropriate, reflecting a concerning lack of professionalism and respect.

The incident also shed light on the U.S. Border Patrol’s utilization of an unmoderated and unrecorded tactical radio frequency, contributing to command-and-control deficiencies. This operational shortcoming hindered the OPR’s ability to thoroughly investigate the matter, highlighting the need for improved communication protocols.

While the investigation focused on specific instances of inappropriate behavior and operational failures, it also emphasized the importance of addressing these shortcomings and implementing corrective measures.
