Marfa PD Fails to Investigate Formal Complaint, Potentially Violating Texas Government Code

The Marfa Police Department may have violated Texas Government Code after failing to properly investigate a formal complaint that was acknowledged earlier this year. Despite clear evidence that the complaint was received, no investigative findings have been provided to the complainant, as required by law.

The involvement of Sylvia Borunda Firth, of counsel with the Bojorquez Law Firm in Austin, clearly confirms that the Marfa PD received the complaint. Firth initially responded to the complainant, requesting additional evidence, despite the complaint containing detailed information and the existence of video records, including body cam and surveillance footage. While Firth’s response acknowledged receipt of the complaint, no follow-up investigation or required conclusions have been shared with the complainant.

Under Texas Government Code §614.023, law enforcement agencies are required to investigate formal complaints and provide a written report of their findings. In this case, the lack of investigative action or communication could represent a violation of the law.

Firth’s acknowledgment of the complaint confirms that the Marfa Police Department was fully aware of its obligation to investigate. However, the failure to comply with the law raises serious concerns about transparency, accountability, and the department’s adherence to legal requirements.

As this issue remains unresolved, questions persist about the department’s commitment to properly addressing formal complaints and maintaining public trust.
